WALL ART DISTRICT — TERMS & CONDITIONS
Welcome to Wall Art District.
These Terms and Conditions govern your use of the Wall Art District website and all purchases made through our online store.
By accessing our website, creating an account or placing an order, you agree to these Terms and Conditions.
1. Business Information
Wall Art District is operated by:
Trading name: Wall Art District
Legal entity: Wall Art District
Email: bmecomsolutions@gmail.com
Telephone/WhatsApp: +27 82 807 0623
Website: wallartdistrict.co.za
2. Products
Wall Art District sells printed wall art and posters in various sizes and designs
We make reasonable efforts to display products accurately. However, colours displayed on a screen may differ slightly from the final printed product due to differences in screens, colour calibration, printing processes, paper and lighting.
Minor colour variation that is reasonably attributable to these factors will not necessarily constitute a defect.
Product dimensions and specifications are stated on the applicable product page.
3. Orders
By placing an order, you confirm that the information supplied by you is complete and accurate and that you are authorised to use the selected payment method.
You will be provided with an opportunity to review your order and correct errors before completing your purchase.
Receipt of an order confirmation does not necessarily mean that we have accepted an order where, for example, payment fails, a product is unavailable, an obvious pricing error has occurred or we are legally prohibited from fulfilling the order.
4. Pricing
All prices are displayed in South African Rand (ZAR).
Prices will state whether VAT is included where Wall Art District is required to charge VAT.
Delivery charges and any other applicable charges will be disclosed during checkout before the customer completes payment.
Wall Art District reserves the right to change prices prospectively without notice.
Changes will not affect orders already validly accepted and paid for, except where permitted by law.
5. Payment
Payment must be made using one of the payment methods displayed at checkout.
Orders will generally only be processed once payment has been successfully authorised or received.
We use third-party payment service providers to process payments. Wall Art District does not intentionally store complete card details where payments are processed directly by the relevant payment provider.
6. Product Availability
Products are subject to availability.
If we cannot fulfil an order after payment has been made, we will notify the customer and provide an appropriate refund or alternative where agreed with the customer.
7. Delivery
Wall Art District delivers within South Africa to locations supported by our courier partners.
Estimated production, dispatch and delivery periods are estimates unless expressly stated otherwise.
Our full delivery terms are contained in our Shipping & Delivery Policy below.
8. Returns and Refunds
Returns, refunds and exchanges are governed by our Returns, Refunds & Exchanges Policy, together with the customer's rights under applicable South African law.
Nothing contained in these Terms is intended to waive or restrict any consumer right that cannot lawfully be excluded.
9. Defective Products
Products supplied by Wall Art District are subject to the statutory protections contained in the Consumer Protection Act.
Defective Products – Statutory Warranty
In accordance with the Consumer Protection Act 68 of 2008, products are subject to the statutory implied warranty of quality. If, within six months of delivery, a product fails to meet the standards required by section 55 of the CPA due to a qualifying defect, the customer may be entitled to return the product at our risk and expense and elect the remedy available under section 56 of the CPA.
This warranty does not apply to damage caused after delivery by misuse, improper handling, incorrect installation or framing, accidents, negligence, exposure to moisture, excessive heat or direct sunlight, normal wear and tear, or alterations to the product, to the extent permitted by law.
Wall Art District may request photographs and/or return of the product so that the alleged defect and cause of damage can reasonably be assessed before a remedy is processed. Nothing in this policy limits a consumer's rights under the Consumer Protection Act.
10. Website Use
You may not use our website for unlawful purposes, attempt to interfere with its security or operation, introduce malicious software, attempt unauthorised access, or reproduce substantial parts of our website without permission.
11. Intellectual Property
The Wall Art District name, website design, original branding, logos, original photographs, graphics and other original material belonging to Wall Art District may not be copied, reproduced or commercially exploited without permission.
Third-party names, trademarks, artwork and other intellectual property appearing on products remain the property of their respective rights holders where applicable.
Nothing on our website grants customers ownership of intellectual property contained in any product.
12. Limitation of Liability
To the maximum extent permitted by South African law, Wall Art District will not be liable for indirect or consequential losses arising from circumstances beyond our reasonable control.
Nothing in these Terms excludes liability or consumer rights that may not lawfully be excluded under the CPA or other applicable legislation.
13. Privacy
Personal information is processed in accordance with our Privacy Policy and applicable South African data-protection legislation, including POPIA.
14. Changes to These Terms
We may amend these Terms from time to time. The version applicable to an order will ordinarily be the version published when the customer placed that order.
15. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
Any consumer rights or dispute-resolution mechanisms available under South African law remain applicable.
RETURNS, REFUNDS & EXCHANGES POLICY
We want customers to receive the poster they ordered in good condition.
This policy must be read together with your statutory rights under South African consumer law.
1. Change-of-Mind Returns
Where a statutory cooling-off right applies to an online transaction, Wall Art District will honour that right in accordance with applicable South African law.
Where permitted by law, the direct cost of returning an unwanted product may be for the customer's account.
Returned products should be appropriately protected and returned in substantially the condition in which they were received, subject to applicable consumer law.
2. Custom and Personalised Products
Products made to a customer's specifications or clearly personalised may be excluded from certain change-of-mind cooling-off rights.
This may include personalised posters containing customer-selected names, dates, photographs, wording or bespoke artwork.
This exclusion does not remove rights relating to products that are defective, incorrectly supplied or otherwise protected under applicable law.
3. Damaged Products
Please inspect your parcel as soon as reasonably possible after delivery.
If your poster arrives damaged, please contact us at:
bmecomsoluions@gmail.com
Please provide your order number and photographs showing:
the poster;
the damage;
the packaging; and
the courier label where reasonably possible.
These photographs help us investigate courier and production issues and do not limit any statutory rights.
4. Incorrect Orders
If Wall Art District sends you the incorrect poster, size or quantity, please contact us.
Where the error is ours, we will provide an appropriate remedy and will not require you to bear return costs where the law places those costs on us.
5. Defective Products
South African consumers have statutory quality protections.
Under section 56 of the CPA, where qualifying goods fail to comply with the statutory standards, a consumer may return them within six months after delivery without penalty and at the supplier's risk and expense and direct the supplier to repair or replace the goods, or refund the price paid.
Examples of potential poster defects may include significant printing defects, materially incorrect cropping, incorrect printing attributable to us, or physical manufacturing defects.
6. What Is Not Normally Considered a Defect
Subject always to applicable law, the following will not ordinarily constitute defects:
minor screen-to-print colour differences caused by monitor settings; damage caused after delivery by incorrect handling, framing, moisture, sunlight or storage; normal wear and tear; or a customer ordering the wrong size where the correct size was supplied.
7. Exchanges
Where an exchange is agreed, availability of the replacement product may depend on stock or production availability.
Where Wall Art District supplied the correct non-defective product and an exchange is requested merely because the customer selected the wrong product or size, shipping costs may be charged where permitted by law.
8. Refund Method
Approved refunds will ordinarily be processed back to the original payment method, where reasonably possible.
Banking and payment-processing times are outside Wall Art District's direct control.
Nothing in this policy permits Wall Art District to delay a refund beyond a statutory deadline where one applies.
9. Statutory Rights
Nothing in this Returns Policy limits any rights available to consumers under the CPA, ECTA or other applicable South African legislation.
The South African Government specifically notes that the CPA's six-month implied warranty does not simply create a general six-month change-of-mind right; it concerns goods that fail applicable quality requirements.
